Please read this agreement carefully because you must accept its terms in order to use the images on the Art Safe CDs. This agreement constitutes a contract between you and Jessica Wesolek/Cre8it.com. You will be asked to agree to it in the Shopping Cart when you purchase a CD. There is nothing scary about it, as the usage rights granted are very broad, and if your intended use is honorable and not covered herein, you may still be able to get permission by contacting us and asking.

It is important to understand that the images in the Art Safe Image Bank are royalty-free and not copyright free, nor are they in the public domain. Because we created the images and own the copyrights to them, we are able to license certain usage rights to you by means of your purchase of the CD. Royalty Free means that you may use the image over again for different projects without having to gain permission each time (as is true with Rights Managed images).

When you purchase Art Safe Image CDs, you agree to the following:

You may use the images in artwork created by you, even if that artwork is made for sale, and even if your work is published in a magazine or book.

You may alter the images in any way you choose to suit your project.

You may make and use as many copies of each image file as you need for your own use. Distribution of these images to a third party, however, is a violation of the License Agreement. When you purchase a CD, you become a Registered User. If someone reports a copyright violation to us, we can easily tell if the person using our image is a Registered User. We will also randomly check for ownership when we see our images used.

You may not include these images in any collection of art for reuse, resale or distribution. This includes collage sheets, clip art, rubber stamps, and anything resembling same.

Main Illustration Clause:
If our image, unaltered, constitutes the main illustration of your finished work, you must include the following information somewhere on the front or back of the piece: Photograph/Image Copyright Cre8it.com/Jessica Wesolek. If such a piece is published, the credit/copyright info must be published with it.

Examples of Main Illustration: If you were to make a set of notecards using our images as the main art and adding a quote or some words or layers of decorative paper. If you used our images to create a book where the images were the main illustration for the theme - like a book on flowers using our garden images. Or, if you are a painter and create a painting using our image as a reference and the finished painting greatly resembles our image. All of these uses are allowed, but credit/copyright must be noted if our images are the main illustration of the art.

This copyright notice is not necessary if our image constitutes 50% or less of the finished work.

Internet Use:
Unaltered Art Safe Images may NOT be used or posted online. While it is allowed to post and display your artwork which contains our images as long as they are not the main illustration, it is not allowed to use our images in their native form on the internet for any purpose. The reason for this is to protect our images from being stolen by download. We have gone to great lengths to render the images we post on our own website almost useless for download thieves, and that effort would be greatly undermined by a licensed user posting a usable copy online.

Commercial Use:
Images may be used to illustrate newsletters, brochures, books, advertisements, and other commercial design work (excluding web design) that is produced by design firms of three or fewer employees. Credit/Copyright must be included on the piece as follows: Photograph Copyright Cre8it.com/Jessica Wesolek

Special Permission:
The spirit of this licensing agreement is to allow artists and designers to use our images to create and sell their own artwork.

We cannot possibly imagine and mention all the uses you may dream up.

So, if you have a project which you feel is not covered herein, please contact us by email and ask about it. Most times, we will grant permission for your project.
